TERMS AND CONDITIONS

By accessing this website and contracting any of the services offered, the client declares to have read, understood, and expressly accepted these Terms and Conditions. The contracting of the service constitutes a legally binding agreement.

1. Acceptance of Service

Acceptance of these Terms and Conditions is mandatory to initiate any project.

2. Payment Method

Payment for the service is due upon completion of the work.

Prices established in the plans cover the services rendered. Hosting must be purchased separately by the client via an invitation sent by email.

⚠️ Failure to pay the final balance implies that the website will not be published or delivered, even if the project is finished.

3. Currency and Payment Processing

All prices are expressed in Canadian Dollars (CAD) based on the current exchange rate in United States Dollars (USD).

4. Delivery Times

The estimated turnaround time is approximately 3 weeks. Delivery periods are established according to the contracted plan and begin once the client purchases their hosting and sends all requested information. Delays in providing information will directly affect the agreed deadlines.

5. Client Default

The service may be canceled without the right to a refund—due to the reservation of time and resources already executed—if the client:

  • Fails to deliver the required material.

  • Fails to respond to official communications.

  • Delays the project beyond the established deadlines.

6. Service Cancellation

In case of cancellation by the client, there is an estimated 30-day window to request a hosting refund through the Hostinger platform. Once payment has been made and the website has been published, cancellations are not accepted. The service will be permanently canceled if the client violates any of these Terms and Conditions or in the event of any lack of respect toward my person or my services as a web designer.

7. Revisions and Scope

Each plan includes a limited number of reasonable revisions. Additional changes, substantial modifications, or requests outside the scope of the contracted plan may incur extra costs.

8. Intellectual Property

The website, design, and development will become the property of the client only once full payment for the service is completed. Until then, all rights belong to the service provider.

9. Third-Party Services

The service includes hosting, domain, and professional email for a period of one (1) year, provided by external platforms such as Hostinger. The provider is not responsible for interruptions, technical failures, or changes in the policies of these external services.

10. Limitation of Liability

The provider does not guarantee specific results such as sales, web traffic, or search engine ranking, as these depend on factors external to the web design and development service.

11. Force Majeure

The provider will not be responsible for delays or failures resulting from causes of force majeure, including but not limited to technical failures, interruptions of external services, health issues, natural disasters, or other circumstances beyond reasonable control.

12. Official Communication

All official communication regarding the project will be conducted exclusively via email. The client is responsible for reviewing and responding in a timely manner.

13. Proper Use of the Site

The client agrees not to use the website for illegal or fraudulent purposes, or purposes contrary to the laws in force in their jurisdiction.

14. Jurisdiction

This agreement is governed by the laws of Canada, and any dispute shall be submitted to said jurisdiction.
